Please read these Terms of Service ("Terms") carefully before using the ecliptai.com website or the Atlas platform operated by EcliptAI™ ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

EcliptAI provides an autonomous AI Chief of Operations named "Atlas" designed for B2B service providers. Services include AI-driven lead qualification, campaign execution, omnichannel communication, and operational analytics.

2. Waitlist and Onboarding

Submitting an application to the EcliptAI Waitlist does not guarantee acceptance. We reserve the right to approve or deny applications based on operational capacity and business fit.

3. Fees and Payments (Active Clients)

  • Base License: Access to the Atlas platform requires a monthly licensing fee (starting at $997.00 USD/month).
  • Custom Build Fees: Initial architectural mapping and API integrations are scoped as a one-time, non-refundable custom build fee.
  • Revenue Share: EcliptAI may charge an agreed-upon performance fee (e.g., 10%) on closed revenue directly attributed to Atlas's automated bookings.
  • Billing: Failure to pay monthly fees will result in the suspension of your Atlas agent.

4. Communications and SMS

By submitting your phone number and checking the consent box, you agree to receive automated promotional and informational text messages and calls from EcliptAI. You understand that consent is not a condition of purchase. Message and data rates may apply. You may opt out of SMS at any time by replying "STOP".

5. Client Responsibilities & Acceptable Use

You agree NOT to use the Atlas AI platform to:

  • Send unsolicited spam, phishing emails, or illegal marketing communications.
  • Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any local privacy regulations.
  • Impersonate any person or entity deceptively.

You are solely responsible for ensuring that the leads and contacts you feed into the Atlas system have legally opted-in to receive communications from your business.

6. Intellectual Property

EcliptAI retains all rights, title, and interest in and to the Atlas AI software, underlying models, workflows, and website content. Clients retain all rights, title, and interest in their proprietary business data, customer lists, and brand assets provided to EcliptAI for training purposes.

7. Limitation of Liability

To the maximum extent permitted by law, EcliptAI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

While Atlas is designed to optimize operations, EcliptAI does not guarantee specific financial results, conversion rates, or business outcomes.
